Kiawah Spit update: Things are happening on the legal front

Kiawah Development Partners (KDP) is adamant about their unwise construction project set to bring in a large profit at the expense of Kiawah Island homeowners and the diverse habitat to be molded to their vision. The SC Environmental Law Project (SCELP) needs your support in order to keep moving forward with their battles. The following letter was sent out by Friends of the Kiawah River on April 22:

I have heard it said that we are losing everything on the legal front. Not true, we won a very important decision with the DHEC Board when we stopped the Sheet Pile Project. Remember that DHEC are the body that sets the rules. Yes, we lost the Bulkhead/Revetment case at the SC Administrative Law Court. We would have liked to win, but we were not surprised when we lost. We knew that, whatever the decision, the case would go to the SC Court of Appeals and probably then to the SC Supreme Court. SCELP has filed an appeal and requested a stop order so that no work can commence until the appeal is heard. KDP has filed an objection and we have responded to that objection.

The property owners on Kiawah Island have shown their support. Well over half signed a petition requesting that the KI Community Association should refuse to pay for damage due to a storm when it hits properties and infrastructure on Captain Sam’s Spit.

DHEC has released a very important document about the future of the SC shoreline and estuaries. It is a long document, but well worth reading. See the link on our website: http://www.kiawahriver.org
